End-User Licence Agreement (EULA)

This End-User Licence Agreement ("EULA") is a legal agreement between you ("End User") and FaultNet ("Licensor") for use of the FaultNet software application and associated services.

By accessing or using FaultNet, you agree to be bound by this EULA. If you do not agree, do not use the software.


1. Licence grant

Subject to your compliance with this EULA and payment of applicable subscription fees, the Licensor grants you a limited, non-exclusive, non-transferable, revocable licence to access and use FaultNet solely for your personal, non-commercial purposes in accordance with this EULA and our Terms of Service.


2. Restrictions

You must not:

a) Copy, modify, distribute, sell or sublicence the FaultNet software or any part of it

b) Reverse engineer, decompile, disassemble or attempt to derive the source code of FaultNet

c) Remove, alter or obscure any proprietary notices or labels on FaultNet

d) Use FaultNet in any way that violates applicable law or third-party rights

e) Access FaultNet through automated means (bots, scrapers, crawlers) without our prior written consent

f) Use FaultNet to provide competing services or develop a competing product


3. Ownership

FaultNet is licensed to you, not sold. The Licensor retains all title, ownership and intellectual property rights in and to FaultNet including all updates and enhancements. You acquire no ownership interest by using the software.


4. User-generated content

You retain ownership of content you create within FaultNet (fault cases, timeline entries, vehicle data etc.). By submitting content, you grant the Licensor the rights described in the Terms of Service.


5. AI features

5.1 FaultNet Pro includes AI-powered fault analysis features. These features are provided on an "as is" basis and outputs are for informational purposes only.

5.2 AI-generated outputs are not professional advice (mechanical, engineering, or otherwise) and may contain errors. The Licensor makes no representation as to the accuracy, completeness or reliability of AI-generated content.

5.3 You acknowledge that any action taken based on AI-generated suggestions is taken at your own risk. The Licensor is not liable for any damage, injury or loss arising from reliance on such outputs.

5.4 AI analysis is provided using third-party AI services. By using AI features, you consent to relevant fault case data being transmitted to the AI provider for processing as described in our Privacy Policy.


6. Subscription terms

6.1 Access to Pro features requires an active paid subscription.

6.2 Subscriptions are billed in advance. Cancellation stops future renewals but does not entitle you to a refund for the current billing period.

6.3 Failure to pay subscription fees will result in downgrade to the Standard tier. Your content remains intact.

6.4 The Licensor reserves the right to modify subscription pricing with 30 days' notice.


7. Updates

The Licensor may deploy updates to FaultNet at any time. Updates may add, modify or remove features. Continued use following an update constitutes acceptance of the updated software.


8. Termination

8.1 This licence is effective until terminated.

8.2 Your licence terminates automatically if you breach any term of this EULA or the Terms of Service.

8.3 The Licensor may terminate your licence at any time with or without cause by providing notice to your registered email address.

8.4 On termination: your right to use FaultNet ceases; you must stop all use immediately; provisions that by their nature should survive termination (including Sections 3, 7, 9, and 10) shall survive.


9. Disclaimer of warranties

FAULTNET IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LICENSOR EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

The Licensor does not warrant that FaultNet will operate without interruption or error or that defects will be corrected.


10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO YOUR USE OF OR INABILITY TO USE FAULTNET.

The Licensor's total liability to you for any claim shall not exceed the greater of: (a) the fees paid by you in the 12 months prior to the event giving rise to the claim; or (b) £50.

Nothing in this EULA excludes or limits liability for fraud, death or personal injury caused by the Licensor's negligence.


11. Governing law

This EULA is governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.


12. Changes to this EULA

We may update this EULA from time to time. We'll notify you of material changes by email or a notice in the app. Continued use after the effective date constitutes acceptance.
